This Privacy Policy discloses the privacy practices for www.club-os.com (including all sub-domains, the "Sites"), which are owned and operated by Technique Fitness, Inc. dba Club OS ("Company" or "Club OS" or "We" or "Us" or "Our").   Club OS provides health club management, lead, and retention software subscription services to companies whose employees access the Sites to administer and manage their businesses (“Customers”).  Club OS also provides portal access to customers of our Customers (“End Users”) to enable them to manage their interactions and memberships with our Customers and to manage their own fitness goals. Services provided via the Sites to Customers and End Users may be collectively referred to as “Club OS Services” or “Services.”

This Privacy Policy applies to our collection and use of information from all users, including Customers and End Users, of Club OS Services, including without limitation visitors accessing the Sites, and is incorporated into our Terms of Service and End User Terms.  Please note that this Privacy Policy does not address the privacy practices of third parties, including any third party application or content (including advertising) that may link to or be accessible from or on the Sites, and including those with whom we may share information as set forth below. Additionally, this Privacy Policy does not apply to information collected by us offline or through any other means, including on any other website operated by Club OS or any third party.  Please review the privacy policies of any third parties before you disclose information to them. Through your use of any Club OS Services and/or Sites, you consent to the practices described in this Privacy Policy.

 

Changes to Our Privacy Policy

We may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information and will always be at  https://app.club-os.com/action/Legal/privacy.  By continuing to access or use the Sites and/or the Services after those changes become effective, you agree to be bound by the revised Privacy Policy.

 

 

Collection and Use of Personal Information

We collect information, including personal information from you when you set up a paid subscription account or a registered free account for an End User Portal, or when you submit information to us directly via any form on our Sites, via email, or via any other electronic mechanism. For purposes of this policy, “personal information” refers to any information about an identified or identifiable individual, including financial account information, health information, and personal identifiers such as social security numbers and drivers’ license numbers.  “Customers” refers to the registered Users of the Club OS Services on whose behalf Club OS processes payments, collects certain consumer information, executes marketing activities, and provides customer management functions. “End Users” refers to consumers about whom Club OS collects personal information on behalf of Customers, and consumers utilizing any Club OS Services in conjunction with a relationship with our Customers, or independently.

We collect personal information from and about Customers through our Services, and we collect personal information from and about End Users that utilize the services of these Customers and/or End Users that enter their personal information directly into a Club OS End User Portal.

Personal Information about consumers may be provided to us by a Customer’s authorized Users of our Services, or directly by the consumers themselves.  By providing information to us through the Services in connection with any one or more Customer subscription accounts, consumers consent to our collection of such information and our sharing of that information with the Customer(s) as set forth in this policy. In cases where authorized Customer Users enter a consumer’s Personal Information into our systems, including in cases where sales leads are imported into our systems, Customers certify that they have received any required authorization to do so from the consumer, and that the disclosure does not violate the PCI DSS or any other law or regulation.

 

We generally collect and use information as follows:

From Visitors to the Sites

When you visit the Sites and submit your personal information to us via any form hosted on the Sites or via email, we use this information to communicate with you about your specific inquiry and to provide information to you about Club OS products and services that we believe may be of interest to you. 

Additionally, our servers (which may be hosted by a third party service provider) collect personal information and other data from you as described in Automated Data Collection Technologies (below).

In order to streamline certain business operations, develop products and services that better meet the interests and needs of our customers, and inform our customers about relevant products and services, you hereby agree that we may share your personal information with any of our current or future affiliated entities, subsidiaries and parent companies. We may also create anonymous records from personal information by excluding information (such as your name) that makes the information personally identifiable to you or one of your customers. We may use this anonymous information for certain business purposes of Club OS or its subsidiaries or affiliates, including but not limited to, directing future development efforts, analyzing usage patterns so that we may enhance our services, and providing reports based on anonymous non-personal information.

 

From Customers with Paid Club OS Subscriptions

To obtain a Paid Club OS Subscription account you must provide contact information (name, address, phone number, and e-mail address) in addition to other personal information about yourself and your company and payment information to authorize automatic recurring billing for your subscription fees.  Club OS does not store any bank account or credit card information in its own systems. All payment card data and bank account data is stored by our third party vendors who are contractually required to maintain compliance with the PCI DSS and to adhere to all NACHA rules for ACH payment processing.

We also collect and store information about your ongoing utilization of the Services and records and copies of your correspondence (including email addresses), if you contact us, including without limitation support requests and requests for additional service.

You may also enter personal information for your own customers and prospects (End Users) as part of using the Club OS Services.  You represent and warrant that you have the right to provide Club OS with any information, content, data, or materials provided by you, and that the disclosure does not violate the PCI DSS or any other law or regulation.

We use your personal information to verify your identity, perform a credit check (if we obtain any necessary consents), and send you messages about your payment transactions, your account status and renewal reminders, changes to the Sites and/or Services, answers to your specific queries, messages related to your uses of the Services, or messages related our company. We use billing and financial information (bank account numbers/credit card numbers) to facilitate payments through the Club OS system and collect fees if applicable.

We may use your personal information to send you promotional products and information about Club OS, the Sites and/or on behalf of our advertisers, partner companies, subsidiaries and affiliates, including but not limited to using the information we have collected from you to enable us to display advertisements to our advertisers' target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Additionally, our servers (which may be hosted by a third party service provider) collect personal information and other data from you as described in Automated Data Collection Technologies (below).We may also create anonymous records from personal information by excluding information (such as your name) that makes the information personally identifiable to you or one of your End Users or consumer prospects. We may use this anonymous information to direct future development, including but not limited to analyzing usage patterns so that we may enhance our services, and providing reports based on anonymous non-personal information.

From End Users Accessing the Sites and Services

Any Personal Information we collect about a consumer or other individual End User, whether entered directly into our systems by the End User, or entered by an authorized Customer User is used solely for the purpose of providing our Services or as otherwise set forth herein.

Club OS processes payments for and collects information from Customers’ customers through our Services.  When you use our Services to enroll for a membership, update your payment information, process a payment or otherwise make a purchase from a Customer, we may collect information necessary to process that transaction, including your name, address, zip/postal code, credit card or financial account number, IP address, and any other information necessary to process or authenticate the transaction. Club OS does not store any bank account or credit card information in its own systems. All payment card data and bank account data is stored by our third party vendors who are contractually required to maintain compliance with the PCI DSS and to adhere to all NACHA rules for ACH payment processing.

Furthermore, we may collect information about you and your purchase, as well as any personal information, health information, or demographic data that you provide at the time of purchase, including (without limitation) your email address, contact information, and other information related to the products/services purchased.

We may store indefinitely, on behalf of our Customer, any payment, health information, personal, and other information collected as part of an End User entering into an agreement with our Customer, collected via an End User entering information via the Services (either via a self-service online portal, or via a system interface provided by our Customer at any of their property locations). The Customer will have access to any personal information provided by End Users via our Services in conjunction with their business relationship with the Customer, including credit card number and other personal information. The Customer may also use the information you provided via the Services for marketing and other similar purposes, and may combine that information with other information the Customer holds about you as set forth in the Customer’s privacy policy or other terms and conditions between you and the Customer. By providing information to us through the Services, you consent to our collection of such information and our sharing of that information with the Customer as set forth in this policy.

Additionally, to make our Sites more useful to you, and to adhere to the PCI DSS, HIPAA, and other applicable laws and regulations our servers (which may be hosted by a third party service provider) collect personal information and other data from you, including (without limitation) browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit. Like most internet services, we automatically gather this information and store it in log files each time you visit our website or access your account on our network.

Additionally, our servers (which may be hosted by a third party service provider) collect personal information and other data from you as described in Automated Data Collection Technologies (below).We may also create anonymous records from personal information by excluding information (such as your name) that makes the information personally identifiable to you or one of your End Users or consumer prospects. We may use this anonymous information to direct future development, including but not limited to analyzing usage patterns so that we may enhance our services, and providing reports based on anonymous non-personal information.

 

 

Automated Data Collection Technologies

When you access the Site or Service or open one of our HTML emails, we may automatically record certain information from your system by using cookies and other types of click-stream tracking technologies. This "automatically collected" information may include Internet Protocol address ("IP Address"), a unique user ID, device type, device identifiers, browser types and language, referring and exit pages, platform type, version of software installed, system type, the content and pages that you access on the Service, the number of clicks, the amount of time spent on pages, the dates and times that you visit the Service, and other similar information. Depending on the law of your country of residence, your IP address may legally be considered personally identifiable information.

We typically use these cookies and similar technologies for essential and functional purposes (e.g. to maintain an active session), to improve the performance and usability of our Sites, and to analyze how users interact with the Services (e.g. to understand how long users stay on a page, how often they return, and how they arrived at our Site). On certain portions of our Sites we may collect data through these technologies for advertising, remarketing, or other similar purposes. Click-stream and related data is typically used for purposes of system administration, to improve our Services, for marketing and advertising-related purposes, and other similar uses.

 

Third-Party Use of Cookies and Other Tracking Technologies

Some tracking technologies on our Services may be provided by a third party (which may collect information on its own behalf, or may provide such information to us). We may use these technologies to collect information about your online activities over time and across third party websites or other online services (behavioral tracking). The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of our Sites and Service. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Sites and Service. If a Customer User or End User declines cookies, they may not be able to fully experience the interactive features of the Club OS Service or Sites.
  • Web Beacons. Pages of our Sites, Service, and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email or opened a text message and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
  • Log Files. We may collect demographic information, such as Zip code, age, gender, preferences, interests and favorites using log files. This information includes IP addresses, browser type, ISP provider, referring/exit pages, operating system, date/time stamp, and click stream data. This information is used to administer the Site and Service, to track users' movements around the Site and Service, and to gather information about the Site and Service End-Users and visitors in the aggregate.

We do not intentionally collect personally identifiable information automatically, but we may tie this information to personal information about you that we collect from other sources or that you provide to us. It is possible at times when collecting non-personally identifiable information through automatic means that we may unintentionally collect or receive personally identifiable information that is mixed in with the non-personally identifiable information. While we will make reasonable efforts to prevent such incidental data collection, the possibility still exists. If you believe that we have inadvertently collected your personal information, please notify us at support@club-os.com.

We may use analytics services that use cookies, javascript and similar technologies to help us analyze how users use the Site or Service. The information generated by these services about your use of the Site and/or Service (including your IP address or a truncated version of your IP address) is transmitted to and stored by analytics service providers on their servers. Those service providers will use this information for the purpose of evaluating your, and other users', use of the Service, compiling reports for us on website activity and providing other services relating to website activity and Internet usage.

For example, in our email programs, Club OS employs some tracking methods (e.g. "targeting, performance, and functionality cookies"). We track "opens" via a tracking pixel in the email- meaning we track who opens our e-mail messages and when you open our e-mail messages; and we track "clicks" via encoded URLs-meaning we track whether you click on the links contained in our e-mail messages.

Additionally, we use Google Analytics on our Sites and in conjunction with our Services. Google Analytics is a web analytics service provided by Google. Google Analytics uses cookies to collect anonymous traffic data to help use analyze how users use the website. The information generated by a cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Sites, compiling reports on Site activity for us and providing other services relating to Site activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. By using the Sites, you consent to the processing of data about you by Google in the manner and for the purposes described in this Privacy Policy.

Advertisers on our Sites and integrated with our Services may also utilize cookies and other tracking technologies. Club OS does not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly.

Alternatively, you can opt out of certain pieces by visiting the Network Advertising Initiative opt out page or permanently using the Google Analytics Opt Out Browser add on. If you wish to take steps to opt-out of tracking by certain online advertisers, you can visit the Digital Advertising Alliance’s opt-out page at http://www.aboutads.info/choices or the Network Advertising Initiative at www.networkadvertising.org/optout_nonppii.asp. You may control Facebook’s use of interest-based ads through your Facebook account settings, or may visit the customer support page here. Please note, at this time we do not respond to browser-based "do not track" signals.

 

When you contact us through the Services

When you submit an online "contact us" or other online inquiry form, create a free account, or when you call, write, fax or otherwise initiate contact with Club OS, we record your contact information (name, address, phone number, and email address) in our CRM (Customer Relationship Management) system. This information is used for answering your questions as well as ongoing marketing communication programs. In some cases, you may be referred to a Club OS online inquiry form via a link on a third party referral website. In that case, any information collected on the Club OS hosted online inquiry form may be shared with the referring party, and that referring party may use it for their own, non-Club OS related, marketing communication programs. If you exchange any messages through our Sites or through our Services, we may store those as well.

 

YOU CONSENT TO RECEIVE AUTODIALED CALLS FROM OR ON BEHALF OF CLUB OS OR A CLUB OS CUSTOMER AT ANY NUMBER PROVIDED TO CLUB OS OR TO A CUSTOMER ON BEHALF OF CLUB OS, WHETHER SUCH NUMBER IS DIRECTED AT A RESIDENCE, A BUSINESS, A WIRELESS TELEPHONE, OR OTHERWISE. YOU UNDERSTAND THAT THIS CONSENT IS NOT A CONDITION OF PURCHASING THE PRODUCTS AND SERVICES OFFERED BY CLUB OS OR ANY CLUB OS CUSTOMER.

 

From Online Surveys

We may occasionally ask Customers and End Users to complete optional online surveys. These surveys may ask for contact information and demographic information (like zip code, age or income level). We may use this data to tailor the Customer’s or End User’s experience on the Sites, providing content that we think might be of interest, and to display content according to the Customer’s or End User’s stated preferences. We sometimes use contact data from our surveys to send you information about our company and/or promotional material on behalf of our partners, subsidiaries or affiliates. We never use personal information about a Customer’s customers collected via surveys to contact those customers directly.

 

Third-Party Advertisers, Services, and Websites

The Club OS Sites and Services contain advertising links to third-party websites. These links are provided for your convenience and to connect you with resources you may find useful. Cub OS has no control of such websites and you understand that these websites are not under our control and are not subject to this Privacy Policy.   Your use and access to these websites is solely at your own risk; and you should consult the Terms and Privacy Policy for any third-party website you access via a Club OS link to determine how they store, process, transmit, and otherwise utilize and protect your personally identifiable information.

Club OS may provide the personal information we have collected from and/or about you to third parties for the purpose of enabling them  to market their products or services to you if you have not opted out of these disclosures.

You may choose to make use of "Non-Club OS Services" in conjunction with our Services. "Non-Club OS Services" are non-Club OS affiliated third-party products, applications, services, networks, systems, directories, websites, databases and information to which our Service links, or to which you may connect or enable in conjunction with the Club OS Services, including without limitation, Non-Club OS Service, which may be integrated directly into your Club OS account or the Club OS Services, to which you grant access privileges. When access is granted, certain End-User Data associated with your account may be shared with the third party, including personally identifiable information. Club OS does not control the policies or procedures of these Non-Club OS Services, even though such Non-Club OS Services are available through our Service. This Policy does not cover the collection or use of information, including Customer Data, by Non-Club OS Services,  and you acknowledge that your use and access to these websites is solely at your own risk; and you should consult the Terms and Privacy Policy for any Non-Club OS Services you access via a Club OS to determine how they store, process, transmit, and otherwise utilize and protect your personally identifiable information and the personally identifiable information you provide about End Users.

 

 

How We Share Information with Third Parties

 

Except as otherwise set forth in this Privacy Policy or in accordance with any request or consent you provide, Club OS does not sell, share, or in any other way transmit personal information (names, address, phone numbers, financial account information, etc.) submitted by non-registered users to any other persons or companies. We reserve the right, however, to use and disclose anonymous information to third parties, at our discretion. Except as limited below, third parties may use information we share with them for any purpose for which we may use such information.

 

Personal information we collect may be shared with service providers who provide certain services on our behalf, including but not limited to, identity verification, credit checks, fraud prevention, business intelligence, customer relationship management, bill collection, payment processing, marketing, hosting, and other common technology services. Our contracts dictate that these service providers only use your information in connection with the services they perform for us and in accordance with this Privacy Policy, and you consent to our sharing with these parties by using our Service and accepting the terms of this Privacy Policy.

 

We may provide information, including personal information of Customers and End Users to third party service providers and referral partners that work on behalf of or with us to provide some of the aspects of our services, to help us communicate with you, or to provide Customers with ancillary services offered by such service providers and referral partners, including but not limited to third parties advertising via the Services and Non-TFI Service providers. We may also receive information about you, including personal information, from our third party service providers and referral partners. However, these service providers and referral partners do not have any independent right to disclose this information (except to the same extent we would have a right to disclose that information under this Privacy Policy).

 

If you contract for service with a Customer and utilize the Services to make payments to the Customer we may grant access to or share with the Customer any and all information we collect as part of that transaction, including credit card and other financial account information, except where that disclosure is prohibited by law, regulation or other obligations (e.g. for data security).

 

You hereby agree that we may share some or all of your personal information with a parent company, subsidiaries, joint ventures, or other companies under common control with us (collectively, "Affiliates"). We will require our Affiliates to comply with this Privacy Policy. If our company or some or all of our assets are acquired by another company, any personal or other information we possess may be a part of the assets transferred, and that company will possess any rights granted to us under this Privacy Policy.

 

Finally, in extraordinary circumstances, we may share any personal or other information we possess, including but not limited to credit card and other financial account information when necessary or appropriate to: comply with the law; cooperate with law enforcement or national security requirements; respond to lawful requests; comply with law or credit card rules; participate in a lawful federal, state or local government investigation; protect the rights of Club OS, other Club OS Customers or End Users, and third parties; or to investigate violations of or to enforce our Terms of Service, End User Terms or Acceptable Use Policy. However, in doing so, we may: (i) dispute demands for release to the extent we believe, in our sole discretion, are unwarranted, illegitimate or overbroad; and (ii) when we determine that it is necessary or appropriate, we will notify you of any requests for release.

 

Data Retention Policy, Managing Your Information

We will retain personal information related to both Customer Users and End Users for as long as the Customer’s Club OS subscription is active and for a reasonable time thereafter.

We may store on behalf of Customers, for as long as a valid business reason exists, which may be indefinitely, any Personal Information, including but not limited to credit card and other financial account information and health information, collected about a consumer or other individual (who may or may not be an End User), whether entered directly into our systems by the End User, or entered by an authorized Customer User.  Additionally, we may retain all personal information stored on behalf of Customers following the termination of the Customer’s account if retention is reasonably necessary to comply with our legal obligations, to meet regulatory requirements, to resolve disputes between End Users or third parties, to prevent fraud and abuse, to provide support and support-related reporting, or to enforce this Policy. 

After termination of a Customer subscription account, we may at our sole descretion, unless legally prohibited, delete from the Service all data, including but not limited to End User data associated with the Customer subscription account,

We may retain anonymized and aggregate data indefinitely.

 

 

A Note About Children

We do not intentionally gather information about visitors who are under the age of 18. If you are under the age of 18 you should not use our Sites or Service.

 

 

Data Security

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored on our thirty party vendor's servers whichutilize the most powerful security tools that exist in the marketplace. 

The Club OS Sites, including hosted web forms, utilize secure SSL for all form data submissions in conjunction with a 256-bit Amazon certificate, but accommodate the majority of browsers at 128-bit encryption.

 

Club OS does not directly store, process, or transmit bank account and credit card information. All payment processing, and collection of payment account data, is accomplished via an integration with third-party service providers.  These providers are contractually required to maintain compliance with the PCI DSS - Payment Card Industry Data Security Standards, and with all NACHA rules for ACH transaction processing.  This includes secure transmission of credit card/bank account information, and encrypted storage of all payment account information.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Site or the Service, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted via our Sites or Services. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Sites or the Services.

 

Choice/Opt-Out

You may opt-out of receiving marketing communications from us by following the opt-out instructions we include in such communications. . You may also notify us that you do not wish your personal information to be included in any data provided to third parties as part of marketing programs targeting Club OS Customers or End Users. We will process your request within a reasonable time after receipt.

To the extent required by law, you may choose to opt out of sharing with any other parties with whom we may share your personal information; however, you may be unable to use the Services or certain features if you wish to limit such sharing.

You acknowledge that Club OS is not responsible for, and in some cases is incapable of, removing your personally identifiable information from the lists of any third party who has previously been provided your information in accordance with this Privacy Policy or your consent. You should contact such third parties directly if you wish to opt-out of receiving marketing or other communications from them.

 

Accessing, Correcting and Deleting your Information

Club OS acknowledges the right of individuals to access their personal data. If you are a Customer, you may access and modify your personal and other account information using your account settings page. You may also access, change and modify information previously provided or collected by sending an email to Club OS at privacy@club-os.com to initiate changes or modifications or to obtain a file for review. Note that Club OS will require you to verify your identity prior to releasing any personal information.

You may close your Club OS Customer account by contacting a Club OS representative at 888-619-0609 or support@club-os.com.

Further, you may request that your personal information be removed from all Club OS systems. This request must be made in writing to the address provided below. Note that if you request removal of your personal information you will no longer have access to any existing Club OS account and will not be able to use any Club OS product or service. Club OS reserves the right to retain certain account information for its recordkeeping or compliance purposes.

If you are a member, customer, or otherwise do business with a Customer that utilizes the Club OS Sites and Services as part of providing service to you, you can request that the Customer provide you with access to the Personal Information Club OS stores on its behalf, that it make changes to that Personal Information, and/or that the Personal Information deleted from PaySimple systems.

Note that using the system delete function to remove any data related to an End User or consumer prospect (such deleting a Customer Record or deleting a credit card or bank account from a Customer Record), or to remove any personal data about your company or its authorized Users (such as deleting a User account), only restricts viewing that data from any system interface and prevents utilizing that data for any system function. It does not permanently delete the data from Club OS systems. To have any personal data permanently deleted from Club OS systems, you must make an official request in writing, to the address provided below or by emailing privacy@club-os.com, that includes the specific information that you would like permanently deleted from Club OS systems. Note that Club OS will require you to verify your identity prior to executing any request to permanently delete data.

California residents may request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. You may make one request each year by contacting us as set forth below.

 

International Transfers

If you are accessing our Services from outside of the United States, any information provided will be transferred to us or our service providers in the United States. Regardless of where your information is collected or transferred, the information will be treated in accordance with this Privacy Policy. You consent to such transfer through your continued use of our Services. Please note that Club OS processes information on behalf of its Customers. Customers may be responsible for obtaining your consents relating to the collection, use, transfer and other processing of your Personal Information, may provide additional notices affecting our processing of your Personal Information, and may provide for additional limitations or permissions with respect to our processing of your information in order to comply with applicable law.

 

No Error-Free Performance
